Terms of Service

1. Agreement to terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”) and Forward Thinking (“we”, “us”, “our”), the operator of CASITANA. By creating an account or using the CASITANA platform, you agree to be bound by these Terms.

2. Description of service

CASITANA is a cloud-based property management platform designed for rental property owners. It provides tools for financial tracking, booking management, document storage, task management, calendar synchronisation, and reporting. The service is offered on a subscription basis.

3. Accounts and eligibility

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate, current, and complete information during registration.
• You may not share your account with others or create multiple accounts to circumvent plan limits.
• You are responsible for all activity that occurs under your account.

4. Subscription plans and billing

CASITANA is offered under the following subscription tiers:

• Free tier: limited access with no payment required.
• Starter (€9.99/month): up to 2 properties, core features.
• Growth (€14.99/month): up to 5 properties, advanced analytics.
• Pro (€24.99/month): unlimited properties, all features.

Annual billing is available at a discounted rate. Prices are shown in EUR and include applicable VAT where required.

Billing begins at the end of your free trial period. You authorise us to charge your payment method on a recurring basis until you cancel. All charges are processed by Stripe and are non-refundable except where required by law.

5. Free trial

New accounts receive a 14-day free trial of the selected paid plan. A payment method is required to start the trial. At the end of the trial period, your card will be charged for the plan you selected unless you cancel before the trial ends. If you do not subscribe, your account will revert to the free tier or be deactivated.

6. Cancellation policy

You may cancel your subscription at any time from your account settings (Account → Subscription → Cancel subscription). Cancellation takes effect at the end of the current billing period — you retain full access until then.

We do not offer refunds for partial billing periods. If you cancel during a trial, you will not be charged. For billing disputes, contact [email protected].

7. Acceptable use

You agree not to:

• Use the service for any unlawful purpose or in violation of any regulations.
• Upload content that is illegal, infringing, harmful, or deceptive.
• Attempt to gain unauthorised access to any part of the platform or its infrastructure.
• Reverse engineer, decompile or attempt to extract source code from the service.
• Resell or commercially redistribute access to the service without our written consent.
• Use automated scripts to scrape, crawl, or extract data from the platform.

8. Your content

You retain ownership of all content you upload to CASITANA (transaction records, documents, photos, etc.). By uploading content, you grant us a limited licence to store and process it solely for the purpose of providing the service to you. We do not claim ownership of your data, and you may export or delete it at any time.

9. Intellectual property

The CASITANA platform, including its design, code, trademarks and content (excluding user-uploaded content), is owned by Forward Thinking and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without our prior written consent.

10. Availability and changes

We aim to maintain 99.5% uptime but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features with reasonable notice. We reserve the right to update these Terms; we will notify you by email at least 14 days before material changes take effect. Continued use constitutes acceptance.

11. Limitation of liability

To the maximum extent permitted by applicable law, Forward Thinking shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the service. Our total aggregate liability for any claims relating to the service shall not exceed the amount you paid in the 12 months preceding the claim.

12. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay outstanding fees. Upon termination, your right to access the service ceases immediately. We will retain your data for 90 days after termination, after which it will be permanently deleted.

13. Governing law

These Terms are governed by the laws of Spain. Any disputes shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to your rights as a consumer under the law of your country of residence within the EU.
